Volunteer Release

I hereby acknowledge and agree to the terms and conditions set forth below in consideration for being permitted by the Salt Spring Farmland Trust (the “FLT”) to participate as a volunteer:

1. Assumption of Risks: I understand and acknowledge that my participation as a volunteer may involve certain risks, including but not limited to physical injury, illness, property damage, and other unforeseen occurrences.

2. Release of Liability: I hereby release, and forever discharge the FLT, and its affiliates, subsidiaries, directors, officers, employees, agents, volunteers, contractors and owners (collectively, the “Releasees”) from any and all manner of actions, causes of action, losses, damages, expenses, suits, contracts, claims, and personal injury, of any nature or kinds whatsoever (including death), whether in law or in equity or pursuant to statute (collectively, the “Claims”) which as against any of the Releasees I may have, arising out of my participation as a volunteer with the FLT.

3. Negligence: The FLT’s agreement to accept me as a volunteer is based on the strict understanding that I assume all of the risk involved in volunteering for the FLT, in any capacity I may agree, from time to time, to volunteer, including the risks to myself as set out in this Agreement and the risks to others as a result of my voluntary work on behalf of FLT, and the Releasees will not be held responsible in any way should I or others become injured or suffer any adverse consequences as set out in this Agreement, even if such injury or adverse consequence arises from faulty or improperly maintained equipment or facilities, incomplete or inadequate instruction, inaccurate assessments of risk, or the negligence or actions of the Releasees or others. I understand that negligence includes failure on the part of any of the Releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of any activities I may be involved in or perform on behalf of the Releasees.

4. Medical Treatment: In the event of an emergency, I authorize the FLT to obtain medical treatment for me if deemed necessary. I understand that I am solely responsible for any costs incurred as a result of such treatment.

5. Photographic Release: I hereby grant the Farmland Trust the right to take photographs and/or videos of me during my volunteer activities. I authorize the Farmland Trust to use and publish such photographs and/or videos for any lawful purpose, including but not limited to publicity, marketing, and promotion. I understand I may withdraw this consent in the future, in writing, but that any withdrawal of consent will not be retroactive.

6. Intoxication: I will not be under the influence of drugs or alcohol or intoxicated in any way during my volunteer participation with the FLT.

7. Voluntary Participation: I certify that I am voluntarily participating as a volunteer with full knowledge of the risks involved, and I agree to abide by all rules, regulations, and instructions provided by FLT and its representatives.

8. Binding Agreement: This waiver and release shall be binding upon my heirs, executors, administrators, and assigns, and shall be governed by and construed in accordance with the laws of British Columbia and that the parties agree to attorn to the jurisdiction of British Columbia.
